Registration under UP Shops & Establishment Act, 1962

The Shop and Establishment Act registration regulates hours of work, payment of wages, leave, holidays, terms of service, and other conditions of work of persons employed in shops, commercial establishments, establishments for public entertainment or amusement, and other establishments and to provide for certain matters connected therewith.

According to the Act ‘Shop’ means any premises where any wholesale or retail trade or business is carried on, or where services are rendered to customers, and includes, all offices, godowns, or warehouses, whether in the same premises or not, which are used in connection with such trade or business.

UP Shops Act  Applicability –

The Shop and Establishment Act is applicable nationwide, and all commercial establishments, such as hotels, and eateries, amusement parks, theatres, and other entertainment houses, as well as any other such public amusement places, come under the purview of the Act.

According to the Act ‘Shop’ means any premises where any wholesale or retail trade or business is carried on, or where services are rendered to customers, and includes, all offices, godowns or warehouses, whether in the same premises or not, which are used in connection with such trade or business.

Commercial establishment’ means any premises, not being the premises of a factory, or a shop, wherein any trade, business, manufacture, or any work in connection with, or incidental or ancillary thereto, is carried on for-profit and includes premises wherein journalistic or printing work or business of banking, insurance, stocks and shares, brokerage or product exchange is carried on, or which is used as a theatre, cinema, or for any other public amusement or entertainment or where the clerical and another establishment of a factory, to whom the provisions of the Factories Act, 1948, do not apply, work;

UP Shops and Establishment Act applies to Shops and establishments situated in the notified municipal area in the district in U.P.

The competent registration authority is the Labor Enforcement Officer.

The owner of a shop must submit a registration application for the shop within 30 days before starting the business.

Documents Required-

  • Photograph of the Shop or Establishment with a name board in the local language.
  • Identity Proof
  • DIN/ PAN Card
  • Treasury Challan/ Bank name

Procedure for Registration

To get a shop registered under the UP Shops and Establishment Act,1962 the following procedure needs to be followed by an applicant:

  1. First of all, open the given web address (www.uplabour.gov.in). The website of the Uttar Pradesh Labor Department will open.
  2. Now click on the “Online Registration and Renewal” link. Once you click on the above you will be directed to the website of the Labor Act Management System.
  3. Read the instructions given on the website. To access the portal, you have to subscribe to the portal.
  4. If you are a new user click on the “Register Now” button and then click on New Registration. Fill the information as required in the form and create a User ID and Password.
  5. Now you have to log in by entering the above User ID and Password. Select the Uttar Pradesh Shops and Commercial Establishment Act, 1962 in “Select Act” on click on the registration button.
  6. Read the given instruction and tick on “I have read all instructions carefully” and click on the “I AGREE” button.
  7. Fill out the given form “Calculate Fee” and submit the form. Now click on Proceed for payment. The payment can be made online using internet banking.
  8. Once the application is submitted and payment is made successfully, the certificate gets generated.
  9. Now you can get the Certificate by clicking on print Certificate.

Registration Fees

The maximum no. of employees employed in the shop on any day during the financial year in respect of which registration is sought will be taken into consideration for deciding the amount of fee leviable.

 Implication / Benefits of Registration

  • The registration is mandatory for several reasons, including the opening of a current account in a bank.
  • The Shop and Establishment Act license, forms as a basic license and proof of your business to apply for other registrations required to run a business in India.
  • The objective of registration is to secure uniform benefits for employees working in different Shops.
  • Registration Certificate shall be valid for 5 years.
  • After the expiry of 5 years, the owner of the Shop can get the registration renewed. It can be renewed for five financial years, which may be up to ten financial years at the time of the next renewal.
  • Any changes made in the details or the closure of such an establishment need to be initiated with the inspector within 15 days of the said change or closure.
